New Sunshine, LLC (“New Sunshine,” “we,” “us,” “our”), along with its subsidiaries and affiliates, is committed to protecting your privacy and ensuring you have a positive experience on our websites. This Privacy Statement (“Statement”) describes how we handle information that can be used to identify you (“Personal Information”), which may include your name, address, email address, phone number, marketing preferences, opinions, etc. This statement applies to our external websites (each individual website being a “Site”) and provides guidance to visitors and users of the Site who are residents of the European Union (“EU”), the European Economic Area (“EEA”), and/or the state of California about the nature of the personal data/personal information we collect and processes about them. Our Statement is designed to comply with applicable laws and regulations, including the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and the California Consumer Privacy Act (“CCPA”), to ensure the privacy and security of personal information. All terms referenced in this Statement not otherwise defined are defined by their meaning under the GDPR and/or the CCPA.  
 
This Statement is applicable globally but may be supplemented by additional information on our privacy practices that may be provided as required by applicable laws and regulations via notices provided at the time of data collection. Further, certain New Sunshine, LLC websites may have additional information not contained in this Statement that describes how we handle Personal Information for those websites specifically. To the extent a notice provided at the time of collection or a website-specific privacy statement conflicts with this Statement, such notice or privacy statement will control. This Statement also supplements and is incorporated into the Terms of Use for this Site.

The types of Personal Information collected and used by New Sunshine, LLC depend on specific activities as described below.

Directly from you when you provide it to us. This includes information you provide by filling in forms on our Site, such as information provided at the time of registering to use our Site or when you purchase our products; by posting comments, reviews, or other communications on the Site; or by requesting further services on the Site, such as when you use the Contact Us link. 
 
Minors. Our Sites are intended to be used by other businesses and adult customers. We do not knowingly collect any Personal Information about minors under the age of 13 (or under the age of 16 for California residents). No information should be submitted to or posted on our Sites by minors.

We will retain your EU Personal Data for as long as your account is active, as needed to provide you services and to fulfill the purposes for which the data was collected, and as necessary to comply with our legal obligations and fulfill our business needs.
 
2. Residents of California
The CCPA provides California residents with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.
 
a. The Right to Know What Information We Have Collected, Disclosed, and Sold 
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months.

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

c. The Right to Opt-Out of the sale of Personal Information to Third Parties
New Sunshine, LLC does not sell Personal Information as defined by the California Consumer Privacy Act (CCPA).
 
d. The Right to Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
 
• Deny you goods or services.
• Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
• Provide you a different level or quality of goods or services.
• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
 
However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time. 
 
e. Exercising Your CCPA Rights
We will take reasonable steps to verify your identity prior to fulfilling the above requests. You may only make a verifiable consumer request for disclosure or deletion twice within a 12-month period. The verifiable consumer request must:

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.
 
We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
